General Terms and Conditions – Swimming Pool & Pond Direct

Article 1 – Identity of the company

Article 2 – Applicability

These general terms and conditions apply to all offers, quotations, agreements and deliveries of Zwembad & Vijver Direct to both consumers and business customers. Deviations from these conditions are only valid if agreed in writing. The conditions are made available to the customer when entering into the agreement and can also be found on the website.

Article 3 – Offer and customization

All products and services offered are custom-made and are specifically tailored to the customer's wishes. Obvious mistakes or errors in the offer do not bind Zwembad & Vijver Direct. Since all products are custom-made, standard models and stock products do not apply.

Article 4 – Conclusion of the agreement

The agreement is concluded after the customer has accepted the offer in writing or verbally and Zwembad & Vijver Direct has confirmed the order. Zwembad & Vijver Direct reserves the right to refuse an order without stating a reason.

Article 5 – Prices and payment

All prices are agreed in advance, in euros, and are inclusive of VAT for consumers and exclusive of VAT for business customers, unless otherwise stated. For custom work, a deposit may be requested, followed by payment of the remaining amount upon delivery. If the payment term is exceeded, the customer is legally in default and statutory interest is due.

Article 6 – Right of withdrawal

Since all products are custom-made, the statutory right of withdrawal is excluded in accordance with article 10 paragraph 1 of the Distance Selling Act. Cancellation of an order is only possible after written confirmation from Zwembad & Vijver Direct and may entail cancellation costs.

Article 7 – Delivery and execution

Delivery will only take place within the Netherlands at the address specified by the customer. Delivery times are indicative. Exceeding the term does not entitle you to compensation or cancellation. Upon delivery, the customer must check the product immediately and report any visible defects within 48 hours.

Article 8 – Warranty and liability

Zwembad & Vijver Direct guarantees that the delivered product complies with the agreement. The guarantee does not apply in the event of incorrect use, poor maintenance or damage caused by third parties. The liability of Zwembad & Vijver Direct is limited to the invoice amount of the delivered product or service.

Article 9 – Complaints procedure

Complaints must be reported in writing within 7 days of discovery. Zwembad & Vijver Direct will respond within 14 days and will endeavor to resolve the problem in consultation with the customer.

Article 10 – Disputes and applicable law

All agreements are exclusively governed by Dutch law. Disputes will be submitted to the competent court in the district where Zwembad & Vijver Direct is established, unless mandatory law provides otherwise.

Article 11 – Orders

11.1 Orders can be placed via our webshop or in our physical store/showroom. 11.2 An order is only final after receipt of payment, unless otherwise agreed. 11.3 After placing an order, the customer will receive a confirmation by e-mail with the details of the order.

Article 12 – Delivery

12.1 We only deliver within the Netherlands. 12.2 Delivery times are approximate and depend on the nature of the product (custom or stock). 12.3 Delays in delivery do not entitle the customer to compensation or termination of the agreement, unless the delay is unreasonably long. 12.4 Delivery takes place at the address specified by the customer. The customer is responsible for the accuracy of the information provided.

Article 13 – Returns

13.1 Consumers have the right to return products within 14 days of receipt without giving a reason, provided that it does not concern custom work. 13.2 Custom products (such as custom-made swimming pools or ponds) are excluded from the right of withdrawal. 13.3 The products must be returned unused, undamaged and in their original packaging. 13.4 The costs for return shipping are for the account of the customer. 13.5 Returns must be registered in advance by e-mail or the return form on the website.

Article 14 – Refunds

14.1 After correct receipt of the return shipment, the purchase amount will be refunded to the customer's account number within 14 days. 14.2 Any original shipping costs will only be refunded if the entire order is returned. 14.3 If the returned product is damaged or shows signs of use, we reserve the right to withhold a depreciation from the amount to be refunded.
